DNA Testing at birth, a valid solution for paternity fraud?

Two cases what happens where there is parallel dating that results in one mother having fraternal twins, each child has a different father.

We think these cases could support DNA testing at birth before placing a man’s name on the birth certificate when he alleged and sworn as the biological father.

The facts are inescapable, that a DNA paternity test is by far the most accurate way to get the truth about paternity. Every child deserves to know the truth for accurate family medical history, lineage and other benefits.

Who’s afraid of the truth? Hint, most men would prefer a DNA paternity test over being victimized by paternity fraud.

Delaware SB171 aka Nathaniel’s law is held hostage

Delaware House committee stonewalls the paternity fraud bill?

The 2010 – 2011 session has brought some promising hope to a special little boy and his mother to correct a paternity fraud problem in Delaware. The great citizens of Delaware should be proud of Senator Bruce Ennis and many other DE lawmakers for sponsoring this bill.

The bill would give judges discretion to correct situations of paternity fraud or paternity mistakes and apply an ounce of prevention to creating additional cases after becoming law. The Nathaniel Act, as affectionately known by supporters, would  help children obtain accurate family medical history from both parents along with the right to be supported by both biological parents.

This would only apply in situations where the alleged, presumed or putative father has been proven as “not the biological father” by a DNA paternity test. It goes without saying, when the legal paternity test results indicate zero percent paternity, there is no way that the accused man caused the mother’s pregnancy of that child.

Thanks to a grass roots advocacy team, Delaware Citizens Against Paternity Fraud (DE-CAPF) led by Roger Hall,  joint collaboration from the DE Family Law Commission and expert assistance from Robert Parker Jr, Director of Legislative  Affairs & Policy (US Citizens Against Paternity Fraud)  — the bill SB171 passed the Senate and referred to the House Judiciary Committee.

Suddenly, the bill SB171 was pulled from the House committee with claims of terrible problems. Among those claims by a House Representative, that the bill should be modified to include language to narrow the scope and limit the use by imposing other hurdles:

  1. Vague language “such as the alleged father should have known that he was not the father” prior to a legal DNA test and;
  2. No requirement of full disclosure of material facts to the alleged father regarding “existence of other paternity candidates”;
  3. NO requirement of notice from the only person that would know pre-testing that the alleged father is NOT the father.
  4. No requirement of a legal DNA paternity test before executing signed paternity confessions nor default judgments
  5. No requirement of legal representation for the man or teenager to fully understand the dangers of signing a paternity confession

And there is more, but why linger? We believe that SB171 could be passed in the House, too “as is”.  We think that it would be great to help Nathaniel now.

It is amazing that the main supporters of the Sb171 are the divorced parents seeking to correct the situation while having to fight the DE family court, DE Appellate Court and child support enforcement agency. If the existing Delaware law did not interfere, the Hall’s could have corrected the paternity of Nathaniel in less than a week, three years ago.  They have been forced to become activist for truth-in-paternity legislation because the courts are upholding little known, Delaware Uniform Parentage Act.

Why are some of the Delaware lawmakers afraid of making truthful paternity, the defacto standard in family court? Obviously the corrective paternity disestablishment law works in Ohio and Georgia while neither state has lost any federal funds meeting paternity quotas.

Hopefully the news of the legislative stonewalling will reach the ears of the Delaware citizens to stop adding new victims of paternity fraud or paternity mistakes.

Paternity Fraud case exposes another marital fraud

Paternity Test answers and raises many questions

An incredible interview about paternity fraud in Pennsylvania. PA is one of the states that adopted the Uniform Parentage Act (UPA) that is often cited as the reason to continue paternity fraud cases against divorced men.

In the case at bar, the formerly married man and the child have been deceived, by the child’s mother and  the reported biological father. Oh, did we mention that the ex-wife is now reported as married to the biological father? Do you see a problem here at all?

So, let’s break down some of the facts:

  1. Wife cheats on husband1 with her boyfriend
  2. Husband1 discovers her affair
  3. Wife1 swears, promises or claims that husband 1 is the father
  4. Wife1 promise the affair is over.
  5. Husband1 discovers the affair again … some time later
  6. Husband1 obtains a home paternity test … he is not the father
  7. Husband1 divorces Wife1
  8. Wife1 marries boyfriend
  9. Husband1 is court ordered to pay child support to ex-wife1 and her new husband (bio-dad)
  10. Court orders new husband (bio-dad) does not have pay child support since Husband 1 is the legal father.
  11. The judge says PA law supports fraud and requires him to ignore the truth, even where fraud exists.
  12. The PA UPA contains time limits that are not published to single and married men. The UPA supports fraud by not placing an equal fiduciary duty to disclose facts and make truthful declarations of paternity.

There’s more to the story — but there has to be something wrong when the law supports fraud and suppresses the truth. Perhaps, PA needs a paternity fraud law that is equal to Ohio or Georgia?

In marital cases where adultery exists, it is quite common a cheating wife will not be tell her husband that he is NOT the father or that he might not be the father.  The facts are clear that married and single men could benefit from obtaining a legal DNA paternity test, shortly after birth and before any legal proceeding.

To be fair, it is also quite common that a cheating husband is not going to tell his wife about his mistress or if he has a child or thinks he has a child with the mistress.  And he cannot be sure of paternity with testing?.

What if some or none of the kids from his wife and mistress are not his? He could become a multi-faceted paternity fraud victim and forced to pay child support to both mothers. It is highly unlikely that a man who has been deceived about paternity by wife and mistress is going to adopt their children. There are laws on the books in some states that would create and enforce child support orders with DNA proof that someone lied.

The facts say dishonesty exists in both sexes, so why have a law that forces men to pay child support for paternity fraud  before providing the man with results of a legal DNA paternity test? Maybe the courts and child support enforcement agencies are not and quite likely were never concerned about the truth. At least as long as some male pays the child support. Could this be called Rent-A-Kid?
