Child Support and Paternity Fraud Issues Threaten Justice
Activist Carnell Smith of US Citizens Against Paternity Fraud joins Civil Rights Advocates at a rally on Saturday, August 18, 2007 at Washington DC’s National Mall to call for protecting civil rights in every area of law, especially family law. Smith recently quoted in TIME magazine and CNN regarding paternity fraud, was the driving force behind the Georgia paternity fraud law.
The public is duped into believing that more federal money is needed by the state child support agencies to collect money from people below the poverty level. How does a person that has not made $100,000 in their lifetime go to jail for a debt of $100,000 and not even be allowed to defend themselves with the evidence and a jury trial?
Justice is missing when people are jailed for child support agency mistakes, for debts that do not exist or that have been paid. For example Robert Parker, Jr LL.B had $15,000 seized and was jailed for 40 days in Michigan on a non-existent child support bill. Eventually, Attorney General Mike Cox’s office confessed error when Parker won his freedom on appeal.
In Atlanta, a 20 year old camera man was jailed for four days on past due child support to a woman and child that he had never met.
The standard answer regarding civil rights violations in court and administrative hearings is “if you don’t like it, try to sue us”. Obtaining justice in family courts can be an elusive and expensive goal for families across the nation.
At the rally, Carnell Smith is one of the speakers that will address the civil rights violations of paternity fraud as an unintended consequence of Social Security laws (Title IV-D) that negatively impact families.
Smith will discuss solutions to the current miscarriages of justice as states pursue federal money to the exclusion of civil and constitutional rights.
The civil and constitutional rights of the people must always be superior to the quest for cash by any state agency.
