Unfortunately, married / divorced men who are residents of Texas, California, Delaware, Michigan, Pennsylvania, New York and other states that support the marital presumption of paternity or the Uniform Parentage Act face an uphill battle against paternity fraud. There are secret time limits that many men are unaware of.
Ie. States that support the Uniform Parentage Act, generally limit paternity challenges to child’s age of 2 to 5 years old with no exceptions for fraud, material mistake of fact nor duress.
Let’s not forget about the states that support the marital presumption aka “marital assumption” that any child born while a man is married to a woman are automatically his, even when:
- Men are proven as sterile
- Legal DNA paternity test results are zero percent paternity
- Husband had no access to wife during actual conception window
- Husband is estranged or legally separated from wife
- Wife is living with her boyfriend not her husband
- Wife admits under oath that her boyfriend or one nighter is the child’s father
Solutions include paternity affidavits and anti-paternity fraud legislation that is equal to or superior to Georgia and Ohio.
