Both parents repay $14,460 to paternity fraud victim

A great story of judicial discretion working to correct a case of paternity fraud in Georgia by holding the mother and the biological father responsible for committing “legal fraud” and/or “actual fraud”.

This should be the legal standard for handling “paternity fraud” cases worldwide.

While it is not the standard, there is good news in Georgia for men and teen boys trapped under a fraudulent child support order for another man’s child (see conditions and exceptions) with OCGA 19-7-54.

The paternity fraud law in effect since May 9, 2002 applies to married, divorced, single men and boys whose child support order originates in Georgia.

Many times the Georgia courts and other courts worldwide rule against the paternity fraud victim citing “best interest of the … mother, state, child support enforcement agency”, er – oops I mean ‘best interest of the child’.

Think about this:

If 20 mothers/annually were assigned to someone else’s child then forced to pay child support under “pay or go to jail”, there would be national coverage and lawsuits galore. Except when you are the wife/girlfriend of a paternity fraud victim — then you get to help pay the woman that lied to your husband / boyfriend for someone else’s child.

DNA testing at birth would have prevented the man in Augusta, GA from being defrauded. Truth by DNA could be the standard in criminal, civil and family court to make decisions based on “Fact” not “Fiction”
