Father suspects paternity fraud, how do I get child support and a dna paternity test?

Question: I’m a mom that is 100 percent sure of my child’s father and am wondering how to get child support. The father denies the baby is his, so I would like to know how to get a dna paternity test. Can someone please help because my child is 8 years old and keeps asking “who is my father” and I would like her to know her father and his family. Please help.

Carnell Smith’s Answer:

There are couple of ways to approach this scenario:
a) Bring legal results to court (faster) or
b) Come to court, court orders a test — then wait weeks/months pending child support agencies case load then return to court again to resolve. Or it maybe possible to obtain an administrative hearing.

1) Come to court with legal paternity test results in-hand, establish paternity and set child support based on state law. Suggestion: Discuss with your parents and guys parents, decide who pays for paternity test then obtain your legal DNA paternity test with yourself, child and alleged father.

If results shows 99.9999% with all three parties tested and the guy does not have an identical twin — he’s the father.

In 4Truth court and in-office services, we have observed that many guys will accept the child’s paternity when proven by legal DNA paternity test. If he does not accept paternity when DNA confirms that he or his soldiers caused the pregnancy — then court can rule a default order against him and proceed to child support determination and payments.

2) Take the private paternity test with yourself, child and alleged father as long as everyone understands why it cannot be used for any legal reasons. Be aware that many family courts and child support agencies will not accept the private paternity test result as proof / non-proof of paternity.

We have observed people spending additional money to obtain a legal test because private paternity tests do not prove identity of sampled persons. It makes more sense to get the legal DNA test in the first round then take your results to child support office, a family law attorney or family court. We do offer private home tests, too.

3) If TANF(welfare) funds are involved in providing care or services for your child, you or the alleged father can request a legal DNA paternity test when filing for services at the child support office. If you qualify, generally there is no or a low fee to the custodial parent for child support services.

We highly recommend our clients get the legal test done before court because of short/long term implications. If the guy is the father — he may be willing to settle out-of-court upon proof that “he is the father”. If he is not willing to settle the paternity lawsuit, the court can and will order payments per state guidelines.

I hope this information helps.

I would go to Child Support Services they do it for free I did that I’m the Dad she says. I just want to make sure since we don’t live together and she has had a Baby in the past with another guy. And we were together at the time that is the big reason why I need this to be done.

I’m not saying I was not with her I just have to make sure it is mine for the above reason. They said the test comes back 6 weeks after the first of next year. I had my Cotton Swab DNA test done in early Dec not sure about my girlfriend.
